Summary of Practice

Specialist advisor and advocate in Chancery, Commercial and Insolvency litigation.

Chancery: Advises and acts in the broad range of Chancery matters. Deals specifically with contentious and non-contentious probate matters, including; will constructions, Inheritance Act applications, breach of trust and tracing claims; claims for an account, actions to remove personal representatives, claims pronouncing for and against the validity of wills. Real property practice includes advising and representing parties at trial in boundary disputes, adverse possession claims, trespass, easement disputes, resulting and constructive trust claims, enforceability of land option agreements; Landlord and Tenant.

Commercial: Advises and acts for parties in a range of commercial disputes, including; building disputes, consumer credit, sale of goods, misrepresentation claims, conflict of laws. Previously has advised the Government Department DEFRA in relation to enforceability of contracts, the Companies Acts and piercing the Corporate Veil.

Insolvency: Advises and acts for parties in all aspects of personal and corporate insolvency, including; acting for Trustees in Bankruptcy seeking possession and sale of property; defending applications for sale; claiming equitable entitlement as against the Trustee, enforcing charging orders against property, petitioning for bankruptcy, presenting winding up petitions against companies; acting in litigation regarding personal liability for use of a prohibited company name. Invited speaker at the Quarterly Meeting of R3 (Association of Recovery Professionals), in Leeds , on the topic of the impact of section 283A of the Insolvency Act 1986 on insolvency litigation in 2007.

Other areas of expertise:

Professional Negligence:

Acted as trial Counsel for solicitors defending professional negligence against them for failure to advise/wrong advice;

Acted as trial Counsel for Architect in long running professional negligence action;

Advised generally on proceeding against a variety of Building Professionals.

Town and Country Planning:

Acted as junior trial Counsel for Bradford Metropolitan District Council in five day public enquiry into contested village green rights.
